Website Terms & Conditions
1. About these Terms
These Website Terms and Conditions (“Terms”) govern your access to and use of www.tryomneo.com and its public content, forms, and related marketing features (the “Website”). The Website is operated by Traction Venture Partners (Pty) Ltd, a private company incorporated in South Africa, which offers Omneo as one of its products (“Traction Venture Partners,” “Omneo,” “we,” “us,” or “our”).
- Registered address: Block A, Wedgefield Office Park, 17 Muswell Road South, Bryanston, Johannesburg, Gauteng, 2021, South Africa
- Company registration number: 2025/480453/07
- Country of establishment: South Africa
- Contact: legal@tryomneo.com
By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
2. Website purpose
The Website provides general information about Omneo, its planned and available capabilities, early-access opportunities, and related resources. The Website currently markets Omneo and does not itself provide the full Omneo SaaS service. Use of the Omneo product application will be governed by separate customer or user terms. If there is a conflict between these Website Terms and a signed customer agreement regarding the product, the signed customer agreement will govern that product use.
3. Eligibility
The Website is intended primarily for people acting in a business or professional capacity. You must be legally capable of agreeing to these Terms. If you use the Website on behalf of an organization, you represent that you have authority to do so. The Website is not directed to children.
4. Waitlist and early access
You may submit information to join the Omneo waitlist. Joining the waitlist:
- does not create a customer relationship or subscription;
- does not guarantee access, selection, availability, features, pricing, territory coverage, or a launch date;
- does not require Omneo to offer the product to you; and
- does not require you to accept an invitation or purchase a service.
Omneo may prioritize, pause, change, or close the waitlist and early-access program. If you are invited to use the product, separate terms may apply.
5. Demo and contact requests
Demo descriptions and conversations are for informational and evaluation purposes. They do not create a binding offer or commitment unless Omneo and the relevant organization sign a separate agreement. You must provide accurate information and must not submit confidential data, credentials, sensitive personal data, or information you are not authorized to share through Website forms or scheduling tools.
6. Product information and availability
We aim to keep Website information useful and accurate, but products and features may change. Images, screenshots, workflows, descriptions, roadmaps, integrations, availability labels, and expected outcomes may be illustrative or subject to update. Unless expressly stated in a signed agreement:
- Website content is not a warranty or guaranteed specification;
- “planned,” “beta,” “early access,” and similar labels describe non-final capabilities;
- inclusion of an integration name or logo does not necessarily mean every feature or permission is supported; and
- no availability date is guaranteed.
7. Permitted use
You may use the Website for lawful business evaluation, information, and communication. You must not: violate applicable law or another person’s rights; interfere with the Website’s security, availability, or operation; attempt unauthorized access to any system, account, data, or restricted area; introduce malware, harmful code, automated abuse, or unreasonable traffic; scrape, crawl, or extract Website content at scale except as permitted by law and our technical instructions; impersonate another person or misrepresent your affiliation; use forms to send spam, unlawful material, secrets, or sensitive data; remove proprietary notices; copy, frame, mirror, republish, sell, or commercially exploit Website content except as permitted by law or written authorization; or use Omneo names, logos, screenshots, or content to suggest endorsement without written permission. We may restrict access where reasonably necessary to protect the Website, our users, or our rights.
8. Intellectual property
The Website and its content — including text, designs, graphics, interfaces, product images, software, trademarks, logos, and other materials — are owned by Omneo or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for its intended purpose. No ownership or broader license is transferred. “Omneo,” the Omneo logo, and related brand elements may not be used without prior written permission, except where applicable law permits.
9. Customer and third-party names and logos
Names, logos, and trademarks belonging to customers, partners, integration providers, or other third parties remain the property of their respective owners. Their appearance on the Website does not grant you a license to use them and should not be interpreted beyond the accompanying approved statement.
10. Feedback
If you voluntarily provide product or Website feedback, you allow Omneo to use that feedback without restriction or payment to improve and develop its business, provided we do not publicly identify you or disclose confidential information without authorization. Do not submit feedback containing information you are not authorized to share.
11. Third-party services and links
The Website may use or link to third-party services, including scheduling, video, chat, analytics, advertising, social media, payment, and product-application providers. Third-party services operate under their own terms and privacy notices. We do not control third-party services and are not responsible for their availability, security, content, or practices, except to the extent responsibility cannot be excluded under applicable law.
12. Privacy and cookies
Our Privacy Policy explains how we process personal data. Our Cookie Policy explains cookies and similar technologies and how to manage preferences.
13. No professional advice
Website content is general information. It is not legal, financial, tax, security, compliance, procurement, or other professional advice. You should obtain appropriate advice for your circumstances.
14. Website availability
We may change, suspend, or discontinue any part of the Website. We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free. We may correct errors and update content without notice.
15. Disclaimers
To the maximum extent permitted by applicable law, the Website and its content are provided “as is” and “as available.” We exclude implied warranties and conditions to the extent legally permitted. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, Omneo will not be liable for indirect, incidental, special, consequential, or punitive loss arising from Website use, including loss of profits, revenue, business opportunity, goodwill, or data. To the maximum extent permitted by law, Omneo’s total liability arising from or relating to the Website will not exceed the greater of (a) the total amount you paid us, if any, for access to the Website in the twelve months before the event giving rise to the claim (which, for this free marketing Website, is normally zero); or (b) ZAR 10,000 (ten thousand South African Rand). Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, or any other liability that applicable law does not allow us to limit.
17. Indemnity for unlawful business use
Where permitted by applicable law, if you use the Website on behalf of a business, that business will be responsible for losses, liabilities, and reasonable costs arising from its material breach of these Terms or unlawful use of the Website. Counsel must confirm whether and how this provision should apply in the selected jurisdiction.
18. Changes to these Terms
We may update these Terms to reflect changes to the Website, our business, or applicable law. The updated version will display a revised “Last updated” date. Where required, we will provide additional notice. Your continued use after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
19. Governing law and disputes
These Terms and disputes relating to them are governed by the laws of the Republic of South Africa, excluding its conflict-of-law rules. The courts of Johannesburg, South Africa will have non-exclusive jurisdiction, except where applicable law gives you a mandatory right to bring a claim elsewhere. If the Website is made available to consumers, additional mandatory consumer-rights and dispute-resolution language may be required; the current commercial intent is business-to-business marketing.
20. General terms
- If a provision is found unenforceable, the remaining provisions remain effective and the affected provision will apply to the maximum lawful extent.
- A delay in enforcing a right is not a waiver.
- You may not transfer your rights under these Terms without our written permission. We may transfer these Terms as part of a reorganization, financing, merger, sale, or transfer of the Website or business, subject to applicable law.
- These Terms, together with the Privacy Policy and Cookie Policy, form the agreement governing public Website use. They do not replace a signed product agreement.
